What are the Penalties for DWI in Missouri?

Any time an individual makes the decision to drink and drive, others may be put in harm's way. If you or a loved one has been arrested for driving while intoxicated (DWI), you should not expect any leniency from St. Louis law enforcement officers, prosecuting attorneys or the courts. When an individual is arrested for DWI in Missouri, he or she faces administrative penalties, in addition to criminal penalties, as DWI is a serious criminal offense. A first time DWI conviction will mean up to 6 months in jail, fines up to $500, a 30-day driver's license suspension with another 60 days of restricted driving privileges, and the possibility of having an ignition interlock device installed on your vehicle. A fee and proof of insurance will also be required to have your license reinstated.

A 2nd DWI conviction in St. Louis, or throughout the state of Missouri, will mean up to 1 year in jail, fines up to $1,000, a one-year driver's license suspension, the required installation of an ignition interlock device and more. Once again, payment of fees and proof of insurance will be required to have your license reinstated. Should the second DWI offense occur within five years of the first conviction you could be facing a five-year license suspension. On a 3rd or subsequent DWI conviction you could be looking at up to 4 years in state prison, up to $5,000 in fines, a possible 10-year license suspension, the required installation of an ignition interlock device and hidden consequences including a permanent criminal record of repeat offenses – a very serious problem.

Brent Labovitz, Attorney at Law, understands the negative impact a DWI arrest or conviction can have on your family, your career and your future. The conviction will remain on your criminal record and may affect your ability to get certain types of jobs, purchase a home, pursue higher levels of education and more. As you will only have 15 days from the time of your license suspension to request an administrative hearing, it is advised you seek legal counsel as soon as possible following your arrest to provide yourself with the best opportunity to preserve your driving privileges, protect your interests and defend your rights.
